Step-by-Step Patent Registration Process

Step 1: Patent Search (Optional but Recommended)

Before applying, conduct a patent search to check if your invention is new and non-obvious.

➡️Purpose: To ensure the invention has not already been patented in Bangladesh or internationally.

Step 2: Prepare the Patent Application

Draft a complete patent specification that includes:

  • Title of the invention
  • Field of invention
  • Background and prior art
  • Detailed description of the invention
  • Drawings (if applicable)
  • Claims
  • Abstract of the invention

There are two types of specifications:

  • Provisional Specification
  • Complete Specification

📄Provisional applications must be followed by a complete specification within 12 months.


Step 3: Filing the Application

Submit the patent application to the DPDT along with the appropriate fee.

➡️Required Documents:

  • Appropriate Form (Application for Patent)
  • Specification (provisional or complete)
  • Drawing, if has
  • Priority documents (if claiming foreign priority under the Paris Convention)
  • Endorsement/Assignment
  • Power of Attorney (for foreign applicants)

➡️Filing Fee: Varies based on the nature of the applicant (individual or company)

📍Foreign applicants must file through a local law firm or agent like NEXORA IP.


Step 4: Pre Grant Publication of the Application

For normal case, after 18 months of filing, the patent application is published in official website of DPDT. For early publication, the applicant must submit a request for publication. Once the application is successfully published, the next step is to file a request for examination.


Step 5: Examination

After filing an examination request, the DPDT conducts formal & technical examination to verify:

  • Proper documentation
  • Compliance with formalities
  • Novelty, inventive step, and industrial applicability

🕒Timeline: Examination may take 4–6 months.


Step 6: Respond to Examination Report (if issued)

If objections are raised, an Examination Report is issued.

➡️ The applicant must respond to the objections within 3 months (extendable upon request).

Step 7: Patent Grant

If the application is accepted, the DPDT issues a Patent Certificate upon submission of sealing fee and the patent is published further for third party opposition.

➡️ Patent is valid for 20 years from the date of filing or priority date as the case may be.


Step 8: Annual Renewal

Patent holders must pay renewal fees annually from the 5th year onward to keep the patent in force.

➡️Failure to pay renewal fees can result in lapsing of the patent.
